Acceptable Use Policy

The purpose of this Acceptable Use Policy("AUP") is to ensure Mesta and its partners can provide services to you in a lawful and compliant manner based upon applicable laws, statutes, ordinances, regulations, and the requirements of banking partners, card/payment card networks partners, and other third party financial partners.

This Acceptable Use Policy ("AUP") applies to your use of Mesta. You agree to be bound by this AUP and any additional terms, conditions, rules or policies that are provided to you in connection with our services, from time to time. This AUP is subject to change at any time without notice, and the changes will be effective when posted. Your continued use of the Services indicates your acceptance and agreement to the updated AUP.

You are independently responsible for complying with applicable laws and our policies. We may monitor your transactions and activities for potential violations of this AUP. Monitoring includes, but is not limited to, reviewing your accounts for retrievals, returns, or chargebacks, as well as using third-party information or sources.

1. Prohibited Uses, Transactions and Prohibited/Restricted Business Types or Activities.

1.1 You may use our Services only for lawful purposes in compliance with the rules and requirements of Mesta and its partners. You may not use our Services:

In any way that breaches any applicable law or regulation, or causes Mesta to breach any applicable law or regulation;
In any manner that is abusive, harmful, or does not comply with any of our terms or policies;
In a way that is non-compliant with the rules, requirements or policies of our sponsor banks, our service partners, or any card or payment association (e.g., VISA, MasterCard, American Express, NACHA).
To process transactions for another business or allow such another business to process transactions via your account
For any unsolicited or unauthorized advertising, promotional material, or any other form of spam; or
To deal in harmful programs such as viruses, spyware, or similar computer code designed to adversely affect the operation of any computer software or hardware.

1.2 Unsupported businesses and transactions

We do not support businesses or transactions which are involved in any of the following categories, such businesses or transactions may be declined. While this list is representative, it is not exhaustive, and we reserve our right to deny our services to any customers at our sole discretion.

1.2.1 Regulated or illegal products and services

Adult content.
Pornography and other visual content depicting explicitly sexual acts.
Services of sexual nature (webcam shows, live chats, prostitution, escorts, etc).
Sexually oriented establishments (massage parlors, strip clubs, gentleman's clubs).
Cannabis.
Products containing CBD.
Any other products or services related to legal marijuana trade.
Certain controlled substances or other products that present a risk to consumer safety.
Smart drugs, nootropic supplements.
Substances that provide similar effects as illegal drugs (kratom, khat, etc.)
Anabolic steroids and peptides.
Drug paraphernalia.
Any equipment, product, or material which is intended for making, using, or concealing drugs
Pharmaceuticals.
Nutraceuticals, pseudo-pharmaceuticals, and other products which make unreasonable health claims not approved or verified by the applicable regulatory body.
Online pharmacies.
Prescription-only pharmaceutical drugs.
Payments for the sale of pharmaceutical products to retail customers are not supported.
Chemicals.
Commodity chemicals.
Counterfeit or unauthorized goods.
Unauthorized sale of designer and/or brand products.
Sale of illegally imported or exported goods.
Gambling.
Lotteries.
Fantasy sports with cash prizes.
Games of chance with cash prizes.
Sales of in-game currencies by unauthorized vendors.
Any type of gambling payments or businesses.
Any other type of businesses related to gambling, up to Mesta's own discretion.
Intellectual property or proprietary rights infringement.
Any product or service that directly infringes or facilitates infringement upon the copyright, patent, trademark, trade secrets, proprietary, or privacy rights of any third party.
Products and services which are not legal in the jurisdiction they are being offered in.

1.2.2 Financial and other professional services

Binary options.
Escrow services.
Using Mesta's account as an escrow account.
Shell banks.
Superannuation funds.
Syndicates.
Trust and corporate service providers that are involved in:
- Opening accounts on behalf of other businesses.
- Offshore company formation.
- Using nominee directors and/or shareholders to obscure company ownership.
Any other financial services operating without a license where one is required.

1.2.3 Other restricted activities

Individuals, entities, or countries subject to international sanctions.
Weaponry, military and semi-military goods and services.Weapons (including weapons of historic significance), military software, or any other goods or services intended for military use.
Unregistered charities are not supported from any regions.
Trade of restricted and/or endangered animal species and products derived from them.
Multi-level marketing, pyramid schemes, get rich quick schemes, referral marketing, Including any other services promising unreasonably high rewards.
Businesses with relations or activity directly or indirectly linked to Cuba.
Predatory Lending Practices: Engaging in unethical lending practices with excessively high interest rates.
High-Risk Investment Schemes: Offering unregulated or high-risk investment opportunities, such as Ponzi schemes.
Environmental Hazards: Operations posing significant environmental risks without compliance with regulations.
Terrorist Financing: Any entity linked to the financing of terrorist activities.
Money Laundering: Businesses involved or suspected of money laundering activities.
Counterfeit and Piracy: Production or sale of counterfeit goods or engaging in intellectual property piracy.
Sanctioned Countries and Entities: Transactions with sanctioned or embargoed countries, entities, or individuals.
Unregulated Cryptocurrency Operations: Cryptocurrency businesses lacking compliance with AML, KYC, and CFT regulations.
Politically Exposed Persons (PEPs): Associations with PEPs that pose a heightened risk of corruption and bribery.
Unlicensed NBFIs and Banks: Operating without regulatory oversight.
Unlicensed Remittance Agents, Exchange Houses, or Money Transfer Agents: Lacking oversight by regulatory bodies.

1.3 You also agree:

not to copy or use any part of our Services in contravention of the provisions of our User Agreement.
not to access without authority, interfere with, damage, or disrupt:
- any part of our Services;
- any equipment or network on which our Website is stored;
- any software / API used in the provision of our Services;
- any equipment, network, or software owned or used by any third party.
not to use your Mesta Account in a manner that is likely to result in complaints, disputes, reversals, chargebacks, or other liabilities to Mesta, other Customers, third parties, or you.

1.4 You may only use your Mesta Account Number to receive funds into your Mesta Account for the following purposes:

receiving payments from your clients and other third parties for the purpose of business transactions and activities

2. Mesta Prohibited Countries and Sanctions List

In adherence to global compliance standards and regulatory obligations, Mesta does not conduct business with individuals, entities, or in countries and regions that are subject to international sanctions. This policy is in strict compliance with the directives issued by international regulatory bodies, our banking-as-a-service providers, and their licensed service providers.

3.1 We take breach of this policy seriously and may take the following actions:

immediate, temporary, or permanent withdrawal of your right to use our Services;
suspend or cancel your transaction orders and take such other actions as we consider necessary;
issue of a warning;
legal action against you including proceedings for reimbursement of all costs on an "all expenses" basis;
reporting and disclosure of information to law enforcement authorities.
